At Art by Anrika, my artwork is created through my own creative process, skill, time and artistic expression. I value the integrity and originality of my work and do not consent to my artwork being used to train, develop, test or improve artificial intelligence systems without my express written permission.

1. No AI Training or Data Mining

Unless I have given express written permission, no artwork, images, illustrations, photographs, designs, digital products or other creative content belonging to Art by Anrika may be:

Used to train, fine-tune or develop artificial intelligence or machine-learning models.
Used as training data or datasets for AI systems.
Scraped, crawled, harvested or collected for the purpose of AI training or development.
Submitted to AI systems for the purpose of analysing, reproducing or learning my artistic style.
Used to create datasets, embeddings, model weights or other AI-related resources.
Used to develop or improve generative AI, image-generation or image-manipulation systems.

This applies whether the artwork is obtained from www.artbyanrika.co.za, social media, online marketplaces, search engines, portfolios, digital products or any other source.

2. No Unauthorised AI Generation or Imitation

You may not use Art by Anrika's artwork as a reference, input, prompt image, image-to-image source or other source material for generating new artwork through an AI system without express written permission.

This includes attempts to generate artwork that deliberately imitates, reproduces or closely replicates the distinctive artistic style, composition or identifiable elements of Art by Anrika's work.

3. No Automated Scraping

Automated systems, bots, crawlers, scripts, data-mining tools or similar technologies may not access, copy or collect artwork from www.artbyanrika.co.za for the purpose of:

AI training;
Machine learning;
Dataset creation;
Image indexing for AI model development;
Style analysis; or
Generating derivative AI content.

Normal search-engine indexing necessary to make the website discoverable to the public is not intended to be prohibited by this policy.

4. Copyright and Intellectual Property

All artwork and creative content belonging to Art by Anrika remains protected by applicable copyright and intellectual property laws.

Making an artwork publicly available online does not constitute permission for third parties to use that artwork for AI training, commercial exploitation, reproduction or the creation of derivative works.

Purchasing an artwork, print or digital product also does not transfer copyright or grant permission to use the artwork for AI training or development.

5. Digital Products

Digital products purchased from Art by Anrika are licensed for the purposes stated in the applicable product terms.

Purchasing or downloading a digital product does not give the purchaser permission to:

Upload the product to an AI platform;
Use it as an AI reference image;
Submit it to an AI training dataset;
Generate derivative artwork using AI based on the purchased artwork; or
Share the files with AI developers or third parties for these purposes.
6. AI Companies and Developers

AI companies, developers, researchers and other organisations may not use Art by Anrika's artwork or content for AI training, dataset creation, model development, testing or commercial AI applications without prior written permission.

Any request for licensing or authorised use must be submitted to:

Permission, if granted, will be subject to a separate written agreement specifying the permitted use.

7. Reservation of Rights

Art by Anrika expressly reserves all rights in its artwork and creative content that are not specifically granted to another party.

Nothing on www.artbyanrika.co.za should be interpreted as granting an implied licence or permission to use Art by Anrika's artwork for artificial intelligence, machine learning or related purposes.

8. Unauthorised Use

If Art by Anrika becomes aware that its artwork has been used without permission for AI training, scraping, dataset creation, reproduction or other unauthorised purposes, we reserve the right to take appropriate action to protect our intellectual property and other legal rights.

This may include requesting removal of the material, contacting the relevant platform or service provider, issuing a copyright or intellectual property complaint, and pursuing any other remedies available under applicable law.
